SHE IS A BALLER

TOURNAMENT PARTICIPATION AGREEMENT, RELEASE OF LIABILITY, WAIVER OF RIGHTS, ASSUMPTION OF RISK, MEDICAL AUTHORIZATION, AND MEDIA RELEASE

PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS.

By registering for, participating in, attending, volunteering at, coaching, officiating, spectating, or otherwise being present at any She Is A Baller™ Tournament, Combine, Camp, Clinic, Showcase, League Event, or Related Activity (collectively, the "Event"), the undersigned participant and/or parent/legal guardian acknowledges and agrees to the following terms and conditions.

This Agreement shall serve as a legally binding waiver, release, assumption of risk agreement, medical authorization, and code of conduct acknowledgment.

I. PARTICIPANT INFORMATION

This Agreement applies to all:

  • Athletes

  • Coaches

  • Team staff

  • Volunteers

  • Officials

  • Media personnel

  • Vendors

  • Spectators

  • Parents/guardians

  • Guests

  • Any other individuals attending or participating in the Event

For purposes of this Agreement, all such individuals shall collectively be referred to as the "Participant."

II. EVENT DESCRIPTION

The Participant voluntarily elects to participate in activities including, but not limited to:

  • Girls flag football competitions

  • Tournament games

  • Camps and clinics

  • Combines and athletic testing

  • Strength and conditioning activities

  • Position-specific training

  • Skills competitions

  • Recruiting showcases

  • Media interviews

  • Educational sessions

  • Team meetings

  • Opening and closing ceremonies

  • Travel activities

  • Lodging activities

  • Recreational activities

  • Spectator activities

  • Vendor areas

  • Promotional activities

  • Any other activities conducted by or associated with She Is A Baller™

III. ACKNOWLEDGEMENT OF VOLUNTARY PARTICIPATION

I acknowledge that participation in the Event is entirely voluntary. I understand that participation in flag football and related activities involves physical exertion, athletic competition, and inherent risks.

I further acknowledge that I have had sufficient opportunity to inspect the facilities, ask questions, and determine whether participation is appropriate.

IV. ASSUMPTION OF RISK

I understand and expressly acknowledge that participation in the Event involves inherent risks, including but not limited to:

Physical Risks

  • Sprains

  • Strains

  • Muscle tears

  • Fractures

  • Concussions

  • Heat illness

  • Dehydration

  • Cardiac events

  • Paralysis

  • Permanent disability

  • Death

Environmental Risks

  • Weather conditions

  • Uneven playing surfaces

  • Field conditions

  • Facility hazards

  • Equipment failures

  • Acts of nature

Competition Risks

  • Player collisions

  • Falls

  • Contact injuries

  • Spectator injuries

  • Travel incidents

  • Transportation accidents

Infectious Disease Risks

  • COVID-19

  • Influenza

  • Respiratory illnesses

  • Communicable diseases

  • Unknown pathogens

I knowingly and voluntarily assume all risks, both known and unknown, even if arising from negligence of released parties.

V. RELEASE AND WAIVER OF LIABILITY

In consideration for being permitted to participate, I hereby release, waive, discharge, and covenant not to sue:

Released Parties:

  • She Is A Baller™, LLC

  • She Strikes League

  • RUiM247

  • Event hosts

  • Schools

  • Facilities

  • Municipalities

  • Tournament directors

  • Event organizers

  • Sponsors

  • Coaches

  • Officials

  • Volunteers

  • Staff

  • Contractors

  • Vendors

  • Media personnel

  • Property owners

  • Affiliates

  • Successors

  • Assigns

  • Agents

  • Representatives

from any and all claims, demands, damages, actions, causes of action, liabilities, losses, expenses, costs, attorney fees, or suits arising from:

  • Participation in the Event;

  • Travel to or from the Event;

  • Presence at the Event;

  • Observation of the Event;

  • Spectating the Event;

  • Lodging arrangements;

  • Transportation;

  • Food services;

  • Equipment use;

  • Medical treatment;

  • Acts or omissions of others;

  • Negligence of the Released Parties;

  • Personal injury;

  • Property damage;

  • Illness;

  • Disability;

  • Death.

This release applies to the fullest extent permitted by law.

VI. MEDICAL CONSENT AND AUTHORIZATION

If emergency medical treatment becomes necessary, I authorize:

  • Emergency medical personnel;

  • Physicians;

  • Hospitals;

  • Athletic trainers;

  • Emergency responders;

  • Event medical staff;

to provide emergency medical treatment deemed necessary.

I understand that:

  • She Is A Baller™ is not obligated to provide medical care;

  • Medical services may not be immediately available;

  • I am solely responsible for all medical expenses incurred.

VII. HEALTH REPRESENTATIONS

I certify that:

  • I am physically capable of participating;

  • I have no known medical condition preventing participation;

  • I have disclosed any significant medical conditions;

  • I understand the physical demands of participation.

I understand that participation despite any known medical condition is undertaken entirely at my own risk.

VIII. CONCUSSION ACKNOWLEDGEMENT

I acknowledge that participation in flag football presents a risk of concussion and traumatic brain injury.

I understand that:

  • Symptoms may not appear immediately;

  • Repeated head injuries may result in permanent impairment;

  • Medical evaluation may be required before returning to play.

IX. MEDIA RELEASE

I understand that photographs, video recordings, livestreams, audio recordings, broadcasts, interviews, and other media may be captured during the Event.

I grant She Is A Baller™, its partners, sponsors, media personnel, affiliates, and assigns the irrevocable right to:

  • Photograph me;

  • Record me;

  • Film me;

  • Livestream me;

  • Broadcast me;

  • Publish my name, image, likeness, voice, statistics, and biographical information.

These rights may be exercised worldwide, in perpetuity, without compensation.

X. CODE OF CONDUCT

Participants agree to:

  • Display sportsmanship;

  • Respect officials;

  • Respect staff;

  • Respect opponents;

  • Respect facilities;

  • Follow all tournament rules;

  • Follow all safety instructions;

  • Follow all facility regulations.

Prohibited conduct includes:

  • Fighting;

  • Harassment;

  • Bullying;

  • Threats;

  • Unsportsmanlike conduct;

  • Property damage;

  • Drug use;

  • Alcohol abuse;

  • Weapons possession;

  • Theft;

  • Discrimination;

  • Verbal abuse;

  • Physical abuse.

Violation may result in:

  • Immediate removal;

  • Suspension;

  • Permanent ban;

  • Forfeiture of registration fees.

XI. PROPERTY DAMAGE

Participants are responsible for damage caused by themselves or individuals under their supervision.

Participants agree to reimburse all damages resulting from their conduct.

XII. PERSONAL PROPERTY

Participants understand that She Is A Baller™ is not responsible for:

  • Lost property;

  • Stolen property;

  • Damaged property;

  • Personal belongings;

  • Equipment;

  • Vehicles.

Participants assume all responsibility for safeguarding their property.

XIII. INDEMNIFICATION

Participant agrees to defend, indemnify, and hold harmless all Released Parties from any claims, losses, liabilities, damages, costs, or expenses arising from:

  • Participant's conduct;

  • Participant's negligence;

  • Participant's violations of rules;

  • Participant's actions or omissions.

XIV. ARBITRATION

Any dispute arising from this Agreement shall be resolved exclusively through binding arbitration in the State of California.

Participant waives the right to:

  • Trial by jury;

  • Class action lawsuits;

  • Collective legal actions.

XV. GOVERNING LAW

This Agreement shall be governed by and construed according to the laws of the State of California.

XVI. SEVERABILITY

If any provision of this Agreement is deemed invalid, the remaining provisions shall remain fully enforceable.

XVII. ENTIRE AGREEMENT

This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements or representations.

XVIII. MINOR PARTICIPANTS

If Participant is under eighteen (18) years of age:

The parent or legal guardian:

  • Consents to participation;

  • Assumes all risks on behalf of the minor;

  • Releases all Released Parties;

  • Indemnifies all Released Parties;

  • Accepts full responsibility for the minor.

XIX. ELECTRONIC SIGNATURE CONSENT

Participant agrees that:

  • Electronic signatures;

  • Digital acknowledgments;

  • Checkbox acceptance;

  • Form submission confirmations;

shall constitute valid and legally binding signatures.

Submission of an online registration form shall serve as Participant's legal signature and acceptance of this Agreement.

XX. ACKNOWLEDGEMENT

I HAVE READ THIS AGREEMENT.

I FULLY UNDERSTAND ITS TERMS.

I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS.

I ACKNOWLEDGE THAT I AM SIGNING THIS AGREEMENT FREELY AND VOLUNTARILY.

I INTEND MY ACCEPTANCE OF THIS AGREEMENT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
